1. Agreement to Terms

By accessing or using Farmland ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Farmland is a variant-aware build orchestration system that provides distributed build execution capabilities through NATS-based event distribution. The Service includes both open-source components and commercial offerings.

3. User Accounts

3.1 Account Creation

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.

3.2 Account Security

You are responsible for:

• Safeguarding your password and account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Farmland and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.2 Open Source Components

Certain components of Farmland are open source and subject to separate license agreements. These licenses are available in the respective repository documentation.

5.3 Your Content

You retain all rights to any content you submit, post, or display through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute such content solely for providing the Service.

6. Subscriptions and Payments

6.1 Paid Services

Some aspects of the Service are provided for a fee ("Paid Services"). You will be billed in advance on a recurring basis (monthly or annually, as applicable).

6.2 Pricing

We reserve the right to modify pricing with 30 days' notice. Continued use after price changes constitutes acceptance of the new pricing.

6.3 Refunds

Refund policies vary by product and license type. Please contact support for specific refund requests.

6.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will be effective at the end of the current billing period.

7.1 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted or error-free service. Maintenance, updates, and unforeseen issues may cause temporary interruptions.

7.2 Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

IN NO EVENT SHALL FARMLAND, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

9. Indemnification

You agree to defend, indemnify, and hold harmless Farmland and its licensees from any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions that should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Farmland operates, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Material changes will be notified at least 30 days before becoming effective. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives to the greatest extent possible, and the remaining provisions will continue in full force and effect.
